İzmir Immigration Lawyer: Residence, Work Permits and Entry Bans

İzmir immigration lawyer help covers every step that decides whether, and on what basis, you can stay in Turkey: residence permits and renewals, work permits, entry bans and deportation orders. Our office in Konak handles these files in English, from the first document check to court if needed.

Key Takeaways

  • You pre-register online at e-ikamet, then hand in your residence file in person at the İzmir Provincial Directorate of Migration Management.
  • Renewals can be filed from 60 days before expiry and never after the permit expires.
  • A residence permit does not give you the right to work; the employer applies for a separate work permit.
  • An entry ban can last up to 5 years and can be challenged from abroad through a lawyer holding your power of attorney.
  • A deportation order must be taken to the administrative court within 7 days of notification.
  • We work in English and Turkish, and with Farsi and Arabic speakers through an interpreter.

Moving to İzmir as an expat: what are the legal steps?

Moving to İzmir as an expat usually involves three legal steps: arriving on a visa or visa-free, applying for a residence permit before that permitted stay ends, and getting a work permit through your employer if you will work. Many expats in İzmir base their first permit on tourism or on a home they own; the sections below explain each step and where it is decided.

How do residence permits work in İzmir?

Most foreigners in İzmir start with a short-term residence permit, usually based on tourism or property ownership. You pre-register online on e-ikamet, then submit the file in person at the İzmir Provincial Directorate of Migration Management (İl Göç İdaresi Müdürlüğü), listed at 855 Sk. No: 40/A, Kemeraltı, Konak (switchboard 0232 402 44 62; appointments are booked on e-ikamet, not by phone).

  • Property: a home in your name can support a permit if it was worth at least USD 200,000 (paid in Turkish lira) when you acquired it and you live in it rather than rent it out. Most of our foreign buyers in İzmir buy in Karşıyaka, Çiğli and Bornova.
  • Tourism: you must show a net monthly income of at least 1.5 times the net minimum wage, plus at least one minimum wage for each family member (e-ikamet required documents).
  • Renewal: file from 60 days before expiry; an extension cannot be filed after the permit expires.

A refusal by the İzmir directorate can be challenged at the İzmir administrative courts within the general 60-day period from written notification, together with a request for a stay of execution. If an extension is refused, you have 10 days to leave Turkey, so send us the decision as soon as you receive it. Our residence permit guide covers the permit types and documents in detail.

Can my family, long-term residence or citizenship follow?

Yes. A family residence permit can be given to the foreign spouse and minor or dependent children of a sponsor living in Turkey, for up to three years at a time but never longer than the sponsor’s own permit. After at least 8 years of continuous residence you can apply for a long-term residence permit with no end date. Turkish citizenship has three main routes: investment, at least 3 years of marriage to a Turkish citizen, or 5 years of continuous residence. You apply to the governorship of your place of residence.

How do work permits work in İzmir?

A residence permit lets you live in İzmir, but working requires a separate work permit under Law No. 6735, and the employer applies for it. If you are already in Turkey, the employer files online through e-İzin; from abroad, you first apply at a Turkish consulate. Complete applications are decided within 30 days, and a work permit also counts as a residence permit.

A refusal can be objected to within 30 days of notification. Because the decision is made by the Ministry in Ankara, a later lawsuit goes to an Ankara administrative court, not a court in İzmir; we file and follow that case from İzmir. National rules, permit types and fees are explained on our work permit in Turkey page.

Can an entry ban be challenged from İzmir?

Yes. Our office runs the whole file from İzmir while you stay abroad. Under Article 9 of Law No. 6458, an entry ban can last up to 5 years and can be extended by up to 10 more years for a serious threat to public order or security. There are two routes:

  • an annotated visa (meşruhatlı vize) for a specific trip, applied for at a Turkish consulate, which consults the Ministry before deciding; the ban stays on your record;
  • an annulment lawsuit at the Ankara Administrative Court, within 60 days from notification.

A power of attorney signed abroad must be apostilled (or legalised) and translated into Turkish by a sworn translator. Our guide to Turkey entry bans under Law No. 6458 explains ban lengths and restriction codes.

What if I face deportation or detention in İzmir?

Overstaying is not the same as deportation. Deportation needs a separate decision. When your visa-free stay, visa or residence permit ends, leaving Turkey within 10 days is generally the safest way to exit without a fine or other problems. If a deportation order is served on you, the 7-day lawsuit period starts at notification.

A deportation order must be taken within 7 days of notification to the administrative court for the area of the governorship that issued it, which is usually the same authority that carries it out. As a rule, you may not be removed during that period or while the case is pending, unless you consent to leave, so read anything you are asked to sign carefully.

Administrative detention is a separate decision, challenged before the criminal judgeship of peace, which decides within 5 days. The removal centre listed for İzmir is the Harmandalı Removal Centre (Harmandalı Geri Gönderme Merkezi), Cumhuriyet Mah., Harmandalı No. 2, Çiğli/İzmir; foreigners refused entry at İzmir Adnan Menderes Airport may instead be held at the airport’s own holding facility. Because a deportation normally brings an entry ban, the lawsuit should also ask for the restriction code to be removed.
